Please read these Terms and Conditions of Use carefully, which contains important information about your rights and obligations.

Thank you for your interest in Istanbul Freight Index (hereinafter “ISTFIX”), which are provided by İstanbul Denizcilik Stratejileri ve Araştırmaları Enstitüsü A.Ş. (hereinafter “IDEAS”)

This document covers the terms and conditions (hereinafter “Terms”) under which you may use the ISTFIX website and information, reports and services provided therein. By logging on to or viewing ISTFIX system you accept and agree to abide by, without limitation or qualification, these Terms. If you do not agree to abide by any of the Terms as noted here, please do not log on to the ISTFIX system. IDEAS may, at any time, decide to modify or revise these Terms.

This agreement supersedes all prior agreements, negotiations and discussions between the parties relating to the subject matter of the agreement and the Client acknowledges that it has not entered into the Agreement in reliance on any statement or representation except in so far as the representation has been incorporated into this Agreement. Save for fraud or fraudulent misrepresentation, Clarksons Research shall have no liability for any such representation being untrue or misleading.

1. Use of Site

The material contained on www.istfix.com identified by the domain name: istfix.com (hereinafter "Website"), including but not limited to text, data, software, graphics, logos and other material is the property of IDEAS who retain full copyright of the Material. Use of the material is granted to the Client in return for an agreed subscription.

Non payment does not release the user from his obligations outlined in this contract.

The user subscription is intended for a single person use only. For multi-user memberships, ISTFIX can provide tailored offers.

Membership options, all of which are subject to these terms and conditions are: free and limited subscription, 3 monthy, 6 monthly and annual subscriptions. IDEAS reserves the right to make changes to the subscriptions without prior notice.

Use of the Material in the Website is granted only to the person (the "Client") with whom IDEAS has contracted. The Client accepts usage limits to the site and that IDEAS may restrict access. IDEAS monitors usage levels and log-in locations and reserves the right to terminate access where usage and download levels are considered excessive.

IDEAS may terminate this agreement at any time upon thirty (30) days prior written notice to the Client. In such case the Client shall be entitled to a pro rata refund of any part of the Subscription paid in advance.

The Client may also terminate this agreement, however will be entitled to use the services until expiry and can not claim a pro rata refund. The Client can not transfer the right of using the website to any third parties. 

2. Use of Material Obtained from the Site

The Client is permitted to download material and use it in support of their daily business internally, and with proper attribution to IDEAS, externally.

The Client confirms that they will use Material only in accordance with the Terms and will, on request, provide IDEAS with full access, in confidence, to their systems and records as IDEAS may require to verify such use. Any failure to provide full access as required shall be a fundamental breach of the Agreement.

If the Client would like to obtain permission of IDEAS to use any of the material in a product on any Website, they are requested to e-mail:admin@istfix.com.

If any user violates any of the Terms, the Client's permission to use the material will be automatically terminated.

3: Limitation of Liability

Although all due effort has been made to provide the most reliable and complete information, IDEAS and ISTFIX do not give any warranty as to the availability, accuracy, completeness, currency or reliability of the information and materıal published on the Website and expressly disclaims all liability for any damage or loss resulting from use of or reliance on the material whatsoever published.

Therefore IDEAS cannot be held liable for any direct, indirect or consequential loss of data, profit, revenue or business (whether direct or indirect), however caused arising from the use of the information and material contained on the Website. In any event users shall verify that the data supplied is what it purports to be and correct in the context given by carrying out independent checks.

IDEAS gives no warranties of any kind concerning the website or the material to the fullest extent permissible by law. In particular, IDEAS does not warrant that the websites or any of its content is virus free and advises the Client to take all precautions in this respect.

4. Copyright

Data on the Website is prepared by ISTFIX and IDEAS for the exclusive use of subscribers to the Website.

Users of the Website are permitted to download material and use it, subject to the provisions of use as set out above.

Where any material is used for external purposes it must include relevant citations and express acknowledgement that copyright in the publication or material is owned by ISTFIX and IDEAS.

IDEAS reserves the right to make changes to the material or presentation of the material without prior notice.

5. Indemnity

The Client agrees and hereby undertakes to hold IDEAS and its affiliated companies, its agents, officers and employees ("Indemnified Parties") harmless against all demands, actions, claims, liabilities, losses, costs, charges and expenses ("Claims") arising out of your use of the material or its breach of the terms of this agreement.

6. Governing Law & Jurisdiction 

The agreement and all legal claims relating to and arising from use of the material shall be subject to and judged in accordance with Turkish law, but nothing in these Terms shall preclude IDEAS taking action in any appropriate jurisdiction.
